1. Acceptance of Terms

By accessing, browsing, or registering on VoteSea ("the Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these terms, you are prohibited from using or accessing this Platform.

2. Description of the Platform

VoteSea is a digital election facilitation platform. We provide tools for administrators to configure ballots, candidates, and registers, and distribute secure access links to verified voters, tabulating outcomes via an auditable system.

3. User Accounts & Security

Institutional administrators must create accounts to configure and host elections. You are solely responsible for:

• Maintaining the confidentiality of your account credentials (passwords).
• All activities that occur under your account.
• Promptly notifying us of any unauthorized access or breach of credentials.

4. Election Organizer Responsibilities

Organizers using the Platform represent and warrant that:

• They possess the authorization to conduct elections for their respective voter constituencies.
• Voter phone numbers and student identifiers were gathered legally and in compliance with local privacy frameworks (such as the Data Protection Act).
• They will not configure fraudulent entries, dummy candidates, or falsified voter registries.

5. Voter Guidelines

Voters accessing VoteSea to submit ballots must:

• Submit only their own credentials (Student ID, Name) for verification.
• Refrain from sharing their secure, single-use voting links received via SMS with any third parties.
• Complete their voting transaction individually without coercion or external interference.

6. Prohibited Activities

Users are strictly prohibited from:

• Attempting to bypass voter verification controls or brute-forcing access tokens.
• Using automated systems (bots, scripts) to generate bulk contact inquiries or message requests.
• Injecting malicious payloads, cross-site scripting (XSS), or attacking database interfaces.
• Attempting denial-of-service (DoS) strikes on the Platform infrastructure.

7. Platform Availability & Maintenance

We strive to offer maximum uptime, especially during active election windows. However, VoteSea is provided on an "as-is" and "as-available" basis. We reserve the right to schedule brief maintenance downtime during low-activity windows and make no guarantees of uninterrupted, bug-free operations.

8. Intellectual Property

All proprietary systems, custom components, design sheets, layouts, branding assets, and logo configurations displayed on VoteSea are the exclusive property of the Platform developers. Users acquire no ownership rights by registering or accessing our services.

9. Fees and Payments

Fees for hosting elections are defined in individual service contracts between VoteSea and the respective subscribing institution. Unless specified otherwise, payments must be processed prior to the release of voter links.

10. Limitation of Liability

To the maximum extent permitted by law, VoteSea and its developers shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

• The loss of ballot integrity due to compromised administrative account passwords.
• SMS delivery failures or delays caused by third-party telecom operators or carrier routes.
• Electoral disputes arising from contested candidate criteria or institutional rules.

11. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of Ghana [Governing Law Placeholder], without regard to conflict of law guidelines.
